Eliq Energy Insights Application – Privacy Policy

PRIVACY NOTICE

Eliq AB (“we”, “us” or “Eliq”) is dedicated to protecting your privacy. It is important to us that you are aware of what information we collect about you, how it is collected, and how we use your personal data in connection with your use of the Energy Insights service. In this privacy notice, we also list your rights regarding your data and how to exercise them.

Eliq Energy Insights Application (“service”) is an app- or web-provided service that analyses the way your household uses electricity over time to provide you with analyses on your consumption patterns and recommendations on reducing your energy consumption.

Personal information we collect and where we collect it from
Information we receive from you directly.
We collect information about your estimated annual energy consumption, heating type, hot water system, number of people in the household, type of building (apartment/house/other), size of living space, type of home appliances and devices, information regarding solar panels, electric vehicles, location of your electricity supply point, geographical location, zip code, and inside/outside temperature. We collectively refer to the information above as “household data”, since it is data that relates directly to your household.
Other information we gather from you is your contact information (name and e-mail address or phone number).

Information we collect about you from other sources.
If you have an automatic, “smart” electricity meter and provide consent, Eliq collects information about your electricity consumption from your electricity meter. If you have an automatic “smart” electricity meter, we also collect some of the household data (depending on what can be provided by your meter itself or a national data hub) from your electricity meter, such as geographical location, zip code, location of your electricity supply point and information about inside/outside temperature.

The following national data hubs and consent journeys are supported:

  • UK data hub (In Home Display and Active Card Check) via N3RGY (N3RGY Limited, 11203504 registered at 4 Ovington Drive, Fleet, GU51 1DF)
  • Flanders, Belgium data hub via Fluvius (https://www.fluvius.be/)
  • Swedish data hub via Ediel (https://www.ediel.se/ – Svenska Kraftnät)
  • Netherlands data hub via EDSN (https://www.edsn.nl/)

United Kingdom data hub consent

  1. N3rgy data service ( https://n3rgy.com ) is used by Eliq AB to interface with the national smart meter systems in order to collect, store, manage and share with Eliq AB your Smart Meter data. This service uses the Smart Energy Code  (https://smartenergycodecompany.co.uk/)  Party credentials and Party ID of N3RGY LIMITED, incorporated and registered in England and Wales with the company number 11203504 whose registered office is at 4 Ovington Drive, Fleet, United Kingdom, GU51 1DF.
  2. Consent is granted for Consent is granted for 12 months for the following:
    1. Electricity consumption half-hourly & export half-hourly information for electricity and gas half-hourly information where available
    2. Energy tariff information containing information of the price you are charged for electricity consumed
    3. Information identifying the energy meter (number, location, type)
  3. Users can withdraw consent at anytime within the Eliq Energy Insights Mobile Application
  4. Any withdrawal of consent will lead to smart meter data being deleted by both Eliq AB and N3RGY.
  5. Consent must be renewed every 12 months, otherwise it will be withdrawn by Eliq AB via N3RGY.
  6. Upon Expiry of consent
  1. Smart Meter data processing for that property is suspended
  2. All Smart Meter data related to this property is deleted.

What we do with your personal information
Eliq processes personal data for the following purposes and based on the following legal bases:

  • To communicate with you about the services We process your contact information to communicate with you only if you contact us. The legal basis for this processing is our legitimate interest in providing you information related to the service. The processing applies for 365 days after your last use of Eliq Energy Insights Application, at which point we correspond with you. 
  • To develop new services. We process household data and electricity consumption data to develop and improve new Eliq services, if you consent to it. The legal basis for this processing is your given consent. You have a right to recall your consent at any time. The processing continues until you recall your consent or until we consider the data to be irrelevant for the development of new services.

Information we share
We will share your personal data with our suppliers and subcontractors for the purposes described in this privacy notice. Our suppliers and subcontractors are not authorised by us to use or disclose your personal data except as necessary to perform services on our behalf or to comply with legal requirements. We engage electricity suppliers to gather data from electricity meters and cloud service providers for hosting our IT-infrastructure.

In addition, we may disclose information about you, if we are required to do so by law or legal process, to law enforcement agencies following an appropriate request.
We will not sell your personal details to third parties.

Where we process your personal data
We store and process your data within the EU/EEA.

Your rights
You have the right to know what personal data we process about you and you may request a copy free of charge.
You are also entitled to have incorrect data about you corrected and you may ask us to delete your personal data, if for example the personal data is no longer necessary for the purpose it was collected.
You may also object to the processing of certain personal and request to limit the processing of your personal data. Please note that limiting or deleting personal data may disrupt your provided service.

You also have the right to receive your personal data in a machine-readable format and have the data transferred to another party responsible for data processing. If we process personal data about you based on your consent, you have the right to withdraw your consent at any time. Withdrawing your consent does not affect the legality of any processing performed up to that point.
You have the right to lodge a complaint to the Supervisory Authority in the country you live or work in, if you believe that we have not complied with our obligations regarding your personal data. In Sweden the Supervisory Authority is Swedish Authority for Privacy Protection (Sw. Integritetsskyddsmyndigheten), and you can find more information at their website: www.imy.se.

Security
Eliq uses technical and organisational security measures to help protect your personal data against loss and to guard it against access by unauthorised persons. We regularly review our security policies to ensure our systems are secure and protected.

Updates to our privacy notice
This privacy notice may be updated periodically to reflect changes in the service or our collection and use of your personal data. We will notify you of any significant changes to our privacy notice and indicate at the bottom of the privacy notice when it was most recently updated.

Eliq is the responsible entity (controller) for the processing of your personal data as described above. Eliq is subject to Swedish data protection legislation, including the General Data Protection Regulation (GDPR).
